1. INTRODUCTION
Welcome to Inouthomeco.
These Terms of Service ("Terms") govern your access to and use of the Inouthomeco website, online store, services and the purchase of products from us.
Throughout these Terms, "Inouthomeco", "we", "us" and "our" refer to the business operating the Inouthomeco store and website.
"You", "your", "customer" and "consumer" refer to any person accessing our website or purchasing goods from us.
By accessing our website, creating an account or placing an order, you agree to these Terms.
These Terms must be read together with our Return and Refund Policy and Privacy Policy.
Nothing in these Terms is intended to unlawfully exclude, restrict or limit any right available to a consumer under the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") or any other applicable South African law.
Where applicable law gives you greater rights than these Terms, the applicable law will prevail.

3. ELIGIBILITY TO USE OUR WEBSITE
By using our website or placing an order, you confirm that you have the legal capacity to enter into a binding agreement.
Where you place an order on behalf of a company, business or other legal entity, you confirm that you have the necessary authority to act on behalf of that entity.
You must provide accurate, complete and current information when placing an order or creating an account.
We may refuse, suspend or cancel access to our website or services where we reasonably suspect fraud, unlawful activity, abuse of our systems or a material breach of these Terms.
4. PRODUCTS AND PRODUCT INFORMATION
We take reasonable steps to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate.
Product photographs are provided for illustrative purposes.
Actual colours, packaging, branding or minor cosmetic details may vary due to manufacturing changes, supplier updates, screen settings or product batch variations.
Any variation must not amount to a material misrepresentation of the product.
Product accessories, decorations, food, furniture or other items appearing in photographs are not included unless expressly stated in the product description.
Customers are responsible for reading the full product description, specifications, dimensions and usage information before placing an order.
We reserve the right to correct product information where an error is identified.
5. PRICING
All prices are displayed in South African Rand ("ZAR"), unless expressly stated otherwise.
Applicable taxes, delivery costs and other charges will be displayed or communicated where required before the order is completed.
We take reasonable steps to ensure that prices are displayed accurately.
Where a displayed price contains an inadvertent and obvious error, Inouthomeco may correct the error and take reasonable steps to notify affected customers of the error and the correct price, as permitted by applicable law.
We will not rely on this clause to avoid a valid advertised or displayed price merely because the sale is commercially inconvenient to us.
Promotions, discounts and special offers may be subject to stated time periods, stock limits or other disclosed conditions.
6. PLACING AN ORDER
Products placed in a shopping cart are not reserved and may remain available for purchase by other customers until an order is completed.
Before submitting an order, customers must review the order details, including:
The products ordered;
Quantities;
Delivery information;
Contact information; and
The total amount payable.
It is the customer's responsibility to correct any errors before finally submitting the order.
Submitting an order constitutes an offer to purchase products from Inouthomeco.
An automated order acknowledgement or payment notification does not necessarily constitute final acceptance of an order.
An order is accepted by Inouthomeco when we confirm acceptance, dispatch the goods or make the goods available for collection, whichever occurs first.
This provision is subject at all times to applicable consumer legislation.
7. RIGHT TO REFUSE OR CANCEL ORDERS
To the extent permitted by law, Inouthomeco may refuse, place on hold or cancel an order where:
Payment has not been received or authorised;
Payment is reversed, disputed or identified as potentially fraudulent;
Customer information is materially incorrect or incomplete;
We reasonably suspect fraud, identity theft or unauthorised payment activity;
The customer has materially breached these Terms;
The product cannot lawfully be supplied to the customer;
An inadvertent and obvious pricing error has occurred and the requirements of applicable law have been followed;
The product is unavailable and the order cannot reasonably be fulfilled; or
We are prevented from fulfilling the order by circumstances beyond our reasonable control.
Where an order is lawfully cancelled after payment has been received, any refund legally due will be processed in accordance with applicable law and our Return and Refund Policy.
We may request reasonable information necessary to verify the identity of a customer, payment method or transaction before fulfilling an order.
8. FRAUD PREVENTION AND PAYMENT VERIFICATION
Inouthomeco takes payment fraud and unauthorised transactions seriously.
We reserve the right to conduct reasonable fraud, payment and order verification checks.
We may temporarily place an order on hold while verification is completed.
Where reasonably necessary, we may request proof of identity, confirmation of payment or other information relevant to verifying a transaction.
Customers must not use payment information, accounts or personal information belonging to another person without lawful authority.
Suspected fraudulent or unlawful transactions may be reported to the relevant payment provider, financial institution or law enforcement authority where permitted or required by law.
We reserve all legal rights in relation to fraudulent transactions, chargeback abuse and attempted theft.
9. PAYMENT
Payment must be made using one of the payment methods made available by Inouthomeco.
Customers are responsible for ensuring that they are authorised to use the selected payment method.
An order will not be treated as paid until payment has been successfully received or confirmed through the applicable payment provider.
We are not responsible for delays caused solely by a customer's bank, payment provider or incorrect payment information, except to the extent that applicable law provides otherwise.
Inouthomeco does not guarantee that any particular payment method will remain permanently available.
10. STOCK AVAILABILITY
All products are subject to availability.
We take reasonable steps to maintain accurate stock information. However, stock discrepancies may occur as a result of simultaneous purchases, stock damage, stock count discrepancies or circumstances beyond our reasonable control.
We will not knowingly accept payment for products where we have no reasonable basis to believe that the products can be supplied.
Where products become unavailable after an order has been placed, we will notify the customer as soon as reasonably practicable.
Where required by applicable law, amounts paid for unavailable products will be refunded.
We may offer a comparable replacement or alternative product. A substitute will not be supplied as the customer's purchased product without the customer's agreement where consent is legally required.
11. DELIVERY
Delivery is subject to the delivery options, areas, rates and estimated delivery periods made available by Inouthomeco.
Customers must provide a complete and accurate delivery address.
Inouthomeco will not be responsible for additional delay or cost caused by materially incorrect delivery information provided by the customer, except where the error was caused by us.
Delivery dates and times described as estimates are estimates and are not guaranteed delivery appointments unless we expressly agree otherwise.
Where a specific delivery date or period has been agreed, the rights and obligations of the parties will be determined in accordance with applicable law.
A customer or authorised recipient may be required to accept delivery.
Delivery may be treated as completed when the products are delivered to the agreed delivery address and accepted by the customer or a person reasonably appearing to be authorised to receive the order.
Risk in the products will not pass to the customer before delivery where applicable law requires the products to remain at the supplier's risk until delivery.
Where a customer requests delivery to a third party, receptionist, security desk, mailroom or other nominated recipient, delivery to that nominated point may constitute delivery to the customer, subject to applicable law.
12. FAILED DELIVERY
Customers are responsible for ensuring that delivery can reasonably take place at the address provided.
Where delivery fails because:
An incorrect address was provided;
There is no reasonable access to the delivery location;
The customer or authorised recipient is repeatedly unavailable; or
The customer refuses delivery without a lawful reason,
we may charge reasonable additional delivery or redelivery costs to the extent permitted by law.
This clause does not apply where failed delivery was caused by Inouthomeco or its delivery provider.
13. INSPECTION OF DELIVERIES
Customers are encouraged to inspect products as soon as reasonably possible after delivery.
Visible delivery damage, missing products or incorrect products should be reported to:

as soon as reasonably possible.
We may reasonably request photographs, videos, packaging information or other evidence necessary to investigate a claim.
Failure to report an issue immediately does not remove any non-waivable statutory right available to a customer.
Customers must preserve the product and relevant packaging where reasonably necessary for inspection or investigation.
14. RETURNS AND REFUNDS
Returns, exchanges and refunds are governed by our Return and Refund Policy.
For voluntary or change-of-mind returns, Inouthomeco generally accepts qualifying return requests submitted within 7 calendar days from receipt or collection of the product.
The 7-day voluntary returns period does not replace or restrict any statutory rights relating to defective, unsafe or poor-quality goods.
Where ECTA or another applicable law provides a statutory cooling-off right, that right will apply in accordance with the relevant legislation.

15. PRODUCT USE AND CUSTOMER RESPONSIBILITY
Products must be used for their intended purpose and in accordance with all product instructions, warnings and manufacturer recommendations.
The customer is responsible for determining whether a product is suitable for their intended use, except where the customer has expressly informed us of a particular purpose and has reasonably relied on our advice in circumstances recognised by applicable law.
Customers must not:
Misuse or abuse products;
Modify products in an unsafe manner;
Ignore product safety warnings;
Use electrical products with an incompatible voltage or power supply;
Use products contrary to the manufacturer's instructions; or
Allow products to be used in an obviously unsafe manner.
Damage caused by misuse, abuse, unauthorised modification, negligent handling, incorrect installation or use contrary to instructions will not automatically constitute a product defect.
Nothing in this section limits liability or consumer rights that may not lawfully be excluded.
16. IMPORTANT NOTICE REGARDING LIABILITY
PLEASE READ THIS SECTION CAREFULLY.
THIS SECTION LIMITS INOUTHOMECO'S LIABILITY IN CERTAIN CIRCUMSTANCES AND MAY AFFECT YOUR RIGHTS.
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, INOUTHOMECO WILL NOT BE LIABLE FOR LOSS OR DAMAGE THAT IS CAUSED SOLELY BY:
A CUSTOMER'S MISUSE OR ABUSE OF A PRODUCT;
USE OF A PRODUCT CONTRARY TO CLEAR INSTRUCTIONS OR WARNINGS;
UNAUTHORISED MODIFICATION OF A PRODUCT;
INCORRECT INSTALLATION PERFORMED BY THE CUSTOMER OR AN UNAUTHORISED THIRD PARTY;
THE CUSTOMER PROVIDING MATERIALLY INCORRECT INFORMATION;
UNLAWFUL USE OF A PRODUCT; OR
AN ACT OR OMISSION OF AN INDEPENDENT THIRD PARTY FOR WHOM INOUTHOMECO IS NOT LEGALLY RESPONSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INOUTHOMECO WILL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL COMMERCIAL LOSSES THAT WERE NOT REASONABLY FORESEEABLE AS A RESULT OF THE RELEVANT TRANSACTION.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS:
ANY LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED;
LIABILITY ARISING FROM GROSS NEGLIGENCE TO THE EXTENT THAT SUCH LIABILITY MAY NOT LAWFULLY BE EXCLUDED;
ANY RIGHT AVAILABLE TO A CONSUMER UNDER THE CPA;
STATUTORY PRODUCT LIABILITY UNDER APPLICABLE LAW; OR
LIABILITY FOR ANY MATTER WHERE AN EXCLUSION OR LIMITATION WOULD BE UNLAWFUL.
BY PLACING AN ORDER, YOU ACKNOWLEDGE THAT YOU HAVE BEEN GIVEN AN OPPORTUNITY TO READ AND UNDERSTAND THIS IMPORTANT NOTICE.
17. INDEMNITY FOR UNLAWFUL OR WRONGFUL CONDUCT
To the maximum extent permitted by law, you agree to indemnify Inouthomeco against third-party claims, losses or reasonable costs arising directly from:
Your fraudulent conduct;
Your unlawful use of our website or products;
Your deliberate infringement of another person's rights;
Information or content unlawfully submitted by you;
Your unauthorised use of another person's payment information; or
Your material breach of these Terms,
but only to the extent that the relevant claim, loss or cost was caused by your conduct.
This indemnity does not require a consumer to indemnify Inouthomeco for Inouthomeco's own gross negligence or for liability that may not lawfully be transferred to a consumer.
18. WEBSITE AVAILABILITY
We aim to keep our website available and functioning correctly.
However, we do not guarantee uninterrupted or error-free access to the website.
We may temporarily restrict or suspend access for:
Maintenance;
Security updates;
Technical faults;
System upgrades;
Suspected cyberattacks;
Events beyond our reasonable control; or
Other legitimate operational reasons.
We will take reasonable steps to restore services where reasonably possible.
We are not liable for temporary website unavailability to the extent that the unavailability was beyond our reasonable control and liability is not otherwise imposed by law.
19. PROHIBITED WEBSITE USE
You may not use the Inouthomeco website:
For unlawful or fraudulent purposes;
To attempt unauthorised access to our systems;
To distribute malware, malicious code or harmful software;
To scrape, copy or extract website data through automated means where prohibited by law or without our authorisation;
To interfere with website security;
To impersonate another person;
To submit false payment information;
To manipulate promotions, discounts or checkout systems;
To place fraudulent orders;
To conduct chargeback fraud; or
To infringe our intellectual property or the rights of another person.
We may suspend or restrict access where we reasonably believe prohibited conduct has occurred.
We reserve the right to pursue legal remedies for unlawful conduct.
20. CUSTOMER ACCOUNTS
Where customer accounts are available, you are responsible for keeping your login information confidential.
You must notify us as soon as reasonably possible if you reasonably believe that your account has been compromised.
You are responsible for activity performed through your account to the extent that the activity was authorised by you or resulted from your failure to take reasonable steps to protect your login information.
We may suspend an account where there is a reasonable security or fraud concern.
21. INTELLECTUAL PROPERTY
Unless otherwise stated, the Inouthomeco website and its original content, branding, designs, graphics, logos, layout and written content are owned by or lawfully licensed to Inouthomeco.
Third-party product names, trademarks and branding remain the property of their respective owners.
You may use the website for lawful personal or internal business purposes.
You may not, without prior written permission:
Copy our website for commercial use;
Reproduce our original photographs or marketing content for resale or competing commercial purposes;
Use our branding in a manner that suggests affiliation or endorsement;
Create a misleading copy of our website; or
Sell, licence or commercially exploit our original website content.
Nothing in these Terms transfers ownership of our intellectual property to you.
22. REVIEWS, COMMENTS AND CUSTOMER CONTENT
Where customers are permitted to submit reviews, images or comments, the content must be lawful and genuinely related to the customer's experience or the relevant product.
You must not submit:
Fraudulent reviews;
Content belonging to another person without permission;
Defamatory or unlawfully threatening content;
Malicious code;
Illegal content; or
Content containing personal information of another person without lawful authority.
You retain ownership of content you lawfully own.
By submitting content for publication, you grant Inouthomeco a non-exclusive, royalty-free licence to display and reproduce that content for the purpose for which it was submitted and for reasonable promotion of the relevant review or customer feedback, subject to applicable law.
We may remove content where we reasonably believe it is unlawful, fraudulent, irrelevant, abusive or infringes another person's rights.
We will not remove a genuine negative review solely because it is negative.
23. THIRD-PARTY SERVICES AND LINKS
Our website may contain links to or integrate with third-party services, including payment providers, delivery providers and social media platforms.
Third-party services may be subject to their own terms and privacy practices.
Inouthomeco does not control independent third-party websites.
We are not responsible for independent third-party content or conduct except where applicable law makes us legally responsible.
24. PRIVACY AND PERSONAL INFORMATION
Inouthomeco processes personal information in accordance with applicable South African data protection law and our Privacy Policy.
Personal information may be processed where reasonably necessary to:
Process orders;
Receive payment confirmations;
Arrange delivery;
Provide customer support;
Prevent fraud;
Maintain transaction records;
Comply with legal obligations; and
Operate our business.
Our detailed data processing practices, customer rights and contact information are described in our Privacy Policy.
Nothing in these Terms constitutes consent to personal information processing where consent is specifically required by law and has not otherwise been obtained.
25. COMMERCIAL COMMUNICATIONS
Where permitted by law, we may send transactional communications relating to orders, payments, deliveries, returns, security or customer service matters.
Marketing communications will be handled in accordance with applicable law.
Customers may object to or unsubscribe from electronic marketing communications using the applicable unsubscribe method.
Unsubscribing from marketing communications will not prevent us from sending necessary transactional or service communications.
26. PROMOTIONS AND DISCOUNTS
Promotional offers may be subject to additional terms displayed with the relevant promotion.
Unless expressly stated otherwise:
Discounts may not be exchangeable for cash;
Discount codes may be limited to one use per customer or order;
Discounts may not be combined;
Promotions may be subject to stock availability; and
Promotions may have stated opening and closing dates.
We may reject the fraudulent, automated or manipulated use of a promotional offer.
We will not cancel or alter a promotion in a manner that unlawfully deprives a consumer of an already-acquired right.
27. FORCE MAJEURE AND EVENTS BEYOND OUR CONTROL
To the extent permitted by law, Inouthomeco will not be liable for a delay or failure caused by an event genuinely beyond our reasonable control.
Such events may include severe weather, natural disasters, major transport disruptions, civil unrest, war, government restrictions, widespread telecommunications failures, major utility failures or other extraordinary events beyond our reasonable control.
This clause does not excuse a failure caused by Inouthomeco's ordinary or routine operational negligence.
Where an event beyond our reasonable control affects an order, we will take reasonable steps to notify affected customers and manage the order in accordance with applicable law.
28. COMPLAINTS
Customers should first submit complaints to:

Please include your name, order information and sufficient details of the complaint.
We will take reasonable steps to investigate the complaint.
Nothing in these Terms prevents a consumer from referring a dispute to the Consumer Goods and Services Ombud, National Consumer Commission or another competent consumer body where applicable.
Nothing in these Terms prevents either party from exercising a right of legal redress available under South African law.
29. GOVERNING LAW
These Terms and transactions with Inouthomeco are governed by the laws of the Republic of South Africa.
The parties submit to the jurisdiction of competent South African courts and tribunals.
Nothing in this clause prevents a consumer from approaching a court, tribunal, ombud or consumer authority that has jurisdiction under applicable law.
30. ELECTRONIC COMMUNICATIONS
By using our website or communicating with us electronically, you acknowledge that communications and transaction information may be exchanged electronically.
Electronic records, emails and other data messages may be used as evidence of communications and transactions to the extent permitted by applicable law.
A communication sent to admin@inouthomeco.co.za will be regarded as received by us when it enters our information system and is capable of being retrieved and processed, subject to applicable law.
Customers are responsible for ensuring that the email address and contact information supplied to us are accurate.
31. CHANGES TO THESE TERMS
We may amend these Terms from time to time to reflect:
Changes in law;
Changes to our website;
Changes to our business operations;
Security requirements; or
Reasonable changes to our services.
The updated Terms will be published with an updated revision date.
Changes will not retrospectively remove statutory rights or contractual rights that have already accrued to a customer.
The Terms applicable to a completed transaction will generally be the Terms made available at the time the order was placed, except where a change is required by law.
32. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited only to the minimum extent necessary.
The remaining provisions will continue to apply to the extent permitted by law.
33. NO WAIVER
A failure or delay by Inouthomeco to exercise a contractual right does not automatically constitute a permanent waiver of that right.
Any waiver applies only to the specific circumstances in which it is given.
This clause does not permit Inouthomeco to revive a right that has prescribed, expired or otherwise ceased to exist under applicable law.
34. ENTIRE AGREEMENT
These Terms, together with the Return and Refund Policy, Privacy Policy and any specific terms expressly applicable to an order or promotion, constitute the agreement between the customer and Inouthomeco regarding the relevant use of our website and transaction.
This clause does not exclude any representation, warranty or right that applicable law does not permit us to exclude.
